Application Terms of Use

These Terms of Use ("Terms") govern your use of the Kompozit mobile app for iPhone and Android (the "App") provided by Kompozit Inc. ("Kompozit", "we", "us"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Your account

  • You sign in with a one-time code sent to your email address or mobile phone. Keep that email account and phone secure — anyone with access to them can sign in to your account.
  • You must be at least 18 years old, or the age of majority where you live, to use the App.
  • If you use the App on behalf of a company, you confirm that you are authorized to act for it, and these Terms apply to that company too.
  • To see orders and place new ones, your App account must be linked to your Kompozit customer account. Your Kompozit representative does this.
  • You can see where you are signed in and sign out of other devices in Profile → Devices. You can delete your account as described in our App Privacy Policy.

2. Using the App

You agree not to:

  • use the App for any unlawful purpose or in violation of these Terms;
  • access, or try to access, accounts or data that are not yours;
  • interfere with the App's security or operation, or introduce malware;
  • copy, modify, reverse engineer or resell the App, except where the law allows it.

We may suspend or terminate your access if you violate these Terms.

3. Orders, prices and payment

  • Orders placed in the App are offers to buy. An order is accepted when we confirm it. We may decline or cancel an order — for example, if a product is unavailable or a price was shown in error.
  • Prices are set by Kompozit and calculated on our servers at checkout. Prices, product information and availability may change without notice. We may correct errors, including after an order is placed.
  • Large orders may ship by freight. Freight and delivery details are confirmed by your Kompozit representative after you place the order.
  • Colors on your screen may differ from the actual product.
  • Invoices are paid on our secure payment page, which opens in your web browser. Payment terms on your invoice or customer agreement apply.
  • Returns and refunds follow our Refund Policy. Shipping follows our Shipping Policy.
  • If you have a separate written agreement with Kompozit, for example as a dealer or distributor, that agreement controls where it conflicts with these Terms.

4. Notifications

With your permission, the App sends push notifications about your orders, invoices and payments, and announcements from Kompozit. You can choose notification types in Profile → Notifications and turn notifications off in your device settings. Sign-in codes sent by text message may be subject to your carrier's message and data rates.

5. Information you enter

You are responsible for the information you enter in the App, such as project names, addresses and descriptions. It must be accurate and lawful. We use it only to provide our services, as described in our App Privacy Policy.

6. Intellectual property

The App, its content and the Kompozit name and logos belong to Kompozit or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose.

7. Third-party services

The App relies on third-party services — for example, payment processing and message delivery. Their terms and privacy policies apply to your use of them, and we are not responsible for them.

8. Disclaimer

The App is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the App will be uninterrupted or error-free. This section does not affect the warranties that come with the products you buy from us.

9. Limitation of liability

To the maximum extent permitted by law, Kompozit is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the App. Our total liability for any claim related to the App is limited to the greater of the amount you paid for the order the claim relates to, or US $100.

10. Termination

You can stop using the App and delete your account at any time. We may suspend or end your access to the App at any time, with or without notice. Sections 3, 6, 8, 9 and 12 survive termination.

11. Apple and Google

These Terms are between you and Kompozit, not Apple Inc. or Google LLC. Apple and Google are not responsible for the App or its content, and have no obligation to provide maintenance or support for it. If you downloaded the App from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Broward County, Florida, and you consent to their jurisdiction.

13. Changes to these Terms

We may update these Terms. We will post the new version on this page with a new effective date and, for material changes, tell you in the App. If you continue to use the App after changes take effect, you accept the updated Terms.
